These terms are between you and Clapham Digital LLC, Columbus, Ohio, USA (“we”, “us”), which publishes the app named on this page.

This page covers Nowhere in Particular for iPhone, iPad and Android.

We give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own use. You may not copy it, sell it, rent it out, take it apart to get at its code, or remove its notices, except where the law gives you that right regardless. The app and everything in it stays ours or our licensors’.

Use the app lawfully. Don't use it to harm anyone, interfere with Apple’s or Google’s services, or get around how the stores check purchases.

Nowhere in Particular is one purchase through the App Store or Google Play, at the price shown on its store page before you download. There are no ads, no timers, no consumables and no subscription. Prices vary by country and currency, and the store shows you the exact price and any tax before you pay.

There is no account with us. The optional sharing of your finds is covered by the privacy policy.

Nowhere in Particular points you at real places. Drive and walk with your eyes up. Don't use the app while you are driving unless someone else is operating the vehicle, obey traffic laws and posted signs, stay off private property and closed roads, and don't trespass to reach a destination. You are responsible for where you go and how you get there.

The main screen gives you a direction and a distance. Neither it nor the map knows about closures, weather, private land or whether a place is safe to reach, so that part is on you.

Destinations are real public places taken from published survey data. We can't promise a place is open, still there, or reachable, and the app does not tell you what is at a marker. The marker data is published under the Open Database Licence; the licence and the data are on the data page. Maps in the app are drawn by Apple (on iOS) or Google (on Android), under their terms.

You get the app through Apple’s App Store or Google Play, and the store’s own terms apply to that download. On iPhone and iPad, Apple’s standard Licensed Application End User License Agreement applies to the app alongside these terms. If the two disagree, these terms control, except for the rights Apple’s agreement reserves to Apple. Apple and Google are not parties to these terms, and are not responsible for the app, its support or your claims about it; those are ours.

We build Nowhere in Particular with care and fix what's broken, but we can't promise nothing will go wrong on every device. To the extent the law allows, the software is provided “as is”, and we aren't liable for indirect or consequential loss, or for loss of data or profit, that comes from using it. Our total liability to you for anything connected with the software is limited to the greater of what you paid for it through the store in the twelve months before the claim and US$50.

None of that limits what the law does not allow us to limit: liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

If you are a consumer, these terms take nothing away from the rights your own country’s law gives you that cannot be waived, including the rights of consumers in the European Union and the United Kingdom to digital content that works as described and to a remedy if it does not. Where these terms and one of those rights conflict, the right wins.

These terms are governed by the laws of the State of Ohio, USA. Disputes go to the courts of Ohio, except that if you are a consumer you keep the protection of the mandatory consumer laws of the country where you live and may bring a claim in the courts there. Before anything formal, write to us. Most things get fixed faster that way.

We may update these terms. If the app’s purchase model changes, this page changes with it. A change does not reach back to a purchase you already made; if we change something that matters, we will say so on this page and update the date below. Our privacy policy describes what happens to your data in Nowhere in Particular.
