Wisp
Terms & Conditions
A walking game for iPhone, played on your own streets, so it comes with a few rules about safety.
Who these terms are with
These terms are between you and Clapham Digital LLC, Columbus, Ohio, USA (“we”, “us”), which publishes the app named on this page.
This page covers Wisp for iPhone.
Using the app
We give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own use. You may not copy it, sell it, rent it out, take it apart to get at its code, or remove its notices, except where the law gives you that right regardless. The app and everything in it stays ours or our licensors’.
Use the app lawfully. Don't use it to harm anyone, interfere with Apple’s services, or get around how the stores check purchases.
Price and purchases
Whatever Wisp costs, and whether it has any purchases inside it, is shown on its App Store page before you download. The store shows you the exact price and any tax before you pay. Wisp has no ads, no account with us and no subscription.
If you test Wisp through Apple’s TestFlight, the tester terms are Apple’s, and a test build can change or stop working without notice.
Playing safely
Wisp is played on a real walk. Watch where you are going. Look up often, don't use it while driving, cycling or crossing a road, stay off private property and closed areas, and stop playing if it makes you less aware of what is around you. The screen is built for glances, but a game can't see a kerb for you.
The game does not use the camera and draws nothing over the street. Where a thin spot in the dark leads you is a game, not a map or a recommendation, and we can't promise a place is safe to walk to.
Map data
The street maps come from OpenStreetMap data, which we process and publish under the Open Database Licence. The licence and the data are on the map data page. Maps may be incomplete or out of date, and are not for navigation.
Store terms
You get Wisp through Apple’s App Store, and Apple’s own terms apply to that download. Apple’s standard Licensed Application End User License Agreement applies to the app alongside these terms. If the two disagree, these terms control, except for the rights Apple’s agreement reserves to Apple. Apple is not a party to these terms and is not responsible for the app, its support or your claims about it; those are ours. Wisp checks Apple’s Game Center when it opens, which is Apple’s service under Apple’s terms, not ours.
Warranty and liability
We build Wisp with care and fix what's broken, but we can't promise nothing will go wrong on every device. To the extent the law allows, the software is provided “as is”, and we aren't liable for indirect or consequential loss, or for loss of data or profit, that comes from using it. Our total liability to you for anything connected with the software is limited to the greater of what you paid for it through the store in the twelve months before the claim and US$50.
None of that limits what the law does not allow us to limit: liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Your statutory rights
If you are a consumer, these terms take nothing away from the rights your own country’s law gives you that cannot be waived, including the rights of consumers in the European Union and the United Kingdom to digital content that works as described and to a remedy if it does not. Where these terms and one of those rights conflict, the right wins.
Law and disputes
These terms are governed by the laws of the State of Ohio, USA. Disputes go to the courts of Ohio, except that if you are a consumer you keep the protection of the mandatory consumer laws of the country where you live and may bring a claim in the courts there. Before anything formal, write to us. Most things get fixed faster that way.
Changes and contact
We may update these terms. If Wisp’s price or purchases change, this page changes with them. A change does not reach back to a purchase you already made; if we change something that matters, we will say so on this page and update the date below. Our privacy policy describes what happens to your data in Wisp.
