These terms are between you and Clapham Digital LLC, Columbus, Ohio, USA (“we”, “us”), which publishes the app named on this page.

This page covers Shatterbeat for iPhone, iPad and Android.

We give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own use. You may not copy it, sell it, rent it out, take it apart to get at its code, or remove its notices, except where the law gives you that right regardless. The app and everything in it stays ours or our licensors’.

Use the app lawfully. Don't use it to harm anyone, interfere with Apple’s or Google’s services, or get around how the stores check purchases.

Shatterbeat is free to download and free to play. You get a few free coins each day to continue a run. If you want more, there are two coin packs (consumable) and a one-time FREE PLAY unlock that gives unlimited continues (non-consumable), all sold through the App Store or Google Play at the prices shown there. There are no ads and no subscription, and no account with us.

Coins are a feature of the game, not money. They have no cash value, can't be sold, transferred or exchanged for anything outside the game, and are kept in your own iCloud on iPhone and iPad, or in Google Play Games Saved Games on Android. If you are not signed in to iCloud (iPhone, iPad) or Google Play Games (Android), your coins stay on that device and are lost if you delete the app. They do not move between Apple and Android devices, and we can't see or restore them for you.

Because the store handles payment, the store’s tools apply to these purchases: Apple’s Ask to Buy and Screen Time restrictions, and Google Play’s purchase approvals and parental controls.

Refunds for purchases are decided by Apple or Google, under their policies, and you ask them, not us. A refunded FREE PLAY unlock is removed from the game. If a purchase did not arrive or the game did not credit it, write to us at hello@claphamdigital.com and we will help. None of this limits your statutory rights below.

You get the app through Apple’s App Store or Google Play, and the store’s own terms apply to that download. On iPhone and iPad, Apple’s standard Licensed Application End User License Agreement applies to the app alongside these terms. If the two disagree, these terms control, except for the rights Apple’s agreement reserves to Apple. Apple and Google are not parties to these terms, and are not responsible for the app, its support or your claims about it; those are ours.

We build Shatterbeat with care and fix what's broken, but we can't promise nothing will go wrong on every device. To the extent the law allows, the software is provided “as is”, and we aren't liable for indirect or consequential loss, or for loss of data or profit, that comes from using it. Our total liability to you for anything connected with the software is limited to the greater of what you paid for it through the store in the twelve months before the claim and US$50.

None of that limits what the law does not allow us to limit: liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

If you are a consumer, these terms take nothing away from the rights your own country’s law gives you that cannot be waived, including the rights of consumers in the European Union and the United Kingdom to digital content that works as described and to a remedy if it does not. Where these terms and one of those rights conflict, the right wins.

These terms are governed by the laws of the State of Ohio, USA. Disputes go to the courts of Ohio, except that if you are a consumer you keep the protection of the mandatory consumer laws of the country where you live and may bring a claim in the courts there. Before anything formal, write to us. Most things get fixed faster that way.

We may update these terms. If the coin packs or the unlock change, this page changes with them. A change does not reach back to a purchase you already made; if we change something that matters, we will say so on this page and update the date below. Our privacy policy describes what happens to your data in Shatterbeat.
