Syncopator
Terms & Conditions
Syncopator is free to download, with one optional one-time unlock.
Who these terms are with
These terms are between you and Clapham Digital LLC, Columbus, Ohio, USA (“we”, “us”), which publishes the app named on this page.
This page covers Syncopator for iPhone, iPad and Android.
Using the app
We give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own use. You may not copy it, sell it, rent it out, take it apart to get at its code, or remove its notices, except where the law gives you that right regardless. The app and everything in it stays ours or our licensors’.
Use the app lawfully. Don't use it to harm anyone, interfere with Apple’s or Google’s services, or get around how the stores check purchases.
Price and purchases
Syncopator is free to download. It has one optional purchase, a non-consumable unlock (the App Store or Google Play shows the price in your own storefront, with any tax, before you pay). It lets you start further in, practise any stage at a tempo you choose, and play with extra looks and metronome voices. There are no ads, no coins, no timers, no subscription and no account with us.
The store keeps the record that you own the unlock. Use the restore option in the unlock sheet to re-check it after a reinstall or on another device with the same store account.
Refunds
Refunds for the unlock are decided by Apple or Google, under their policies, and you ask them, not us. A refunded unlock is removed from the game. If your purchase did not unlock, write to us at hello@claphamdigital.com and we will help. None of this limits your statutory rights below.
Store terms
You get the app through Apple’s App Store or Google Play, and the store’s own terms apply to that download. On iPhone and iPad, Apple’s standard Licensed Application End User License Agreement applies to the app alongside these terms. If the two disagree, these terms control, except for the rights Apple’s agreement reserves to Apple. Apple and Google are not parties to these terms, and are not responsible for the app, its support or your claims about it; those are ours.
Warranty and liability
We build Syncopator with care and fix what's broken, but we can't promise nothing will go wrong on every device. To the extent the law allows, the software is provided “as is”, and we aren't liable for indirect or consequential loss, or for loss of data or profit, that comes from using it. Our total liability to you for anything connected with the software is limited to the greater of what you paid for it through the store in the twelve months before the claim and US$50.
None of that limits what the law does not allow us to limit: liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Your statutory rights
If you are a consumer, these terms take nothing away from the rights your own country’s law gives you that cannot be waived, including the rights of consumers in the European Union and the United Kingdom to digital content that works as described and to a remedy if it does not. Where these terms and one of those rights conflict, the right wins.
Law and disputes
These terms are governed by the laws of the State of Ohio, USA. Disputes go to the courts of Ohio, except that if you are a consumer you keep the protection of the mandatory consumer laws of the country where you live and may bring a claim in the courts there. Before anything formal, write to us. Most things get fixed faster that way.
Changes and contact
We may update these terms. If the unlock changes, this page changes with it. A change does not reach back to a purchase you already made; if we change something that matters, we will say so on this page and update the date below. Our privacy policy describes what happens to your data in Syncopator.
