Terms & Conditions

The terms for Video Poker Edge, Blackjack Edge and any Clapham Digital app that does not publish its own.

Who these terms are with

These terms are between you and Clapham Digital LLC, Columbus, Ohio, USA (“we”, “us”), which publishes the apps named on this page.

This page covers these apps:

  • Video Poker Edge — video poker strategy trainer
  • Blackjack Edge — blackjack strategy trainer

It also covers future Clapham Digital apps, except where an app publishes its own terms. These do: Nowhere in Particular, Solitaire Edge, Wisp, Shatterbeat and Syncopator. For those apps, their own page applies and this one does not.

Using the app

We give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own use. You may not copy it, sell it, rent it out, take it apart to get at its code, or remove its notices, except where the law gives you that right regardless. The app and everything in it stays ours or our licensors’.

Use the app lawfully. Don't use it to harm anyone, interfere with Apple’s or Google’s services, or get around how the stores check purchases.

Price and purchases

The price of each app, and any purchase inside it, is shown on its store page before you download. Video Poker Edge is a one-time purchase with no in-app purchases. Prices vary by country and currency, and the store shows you the exact price and any tax before you pay.

There is no account with us and no subscription, and these apps show no ads.

Training tools, not gambling

Video Poker Edge and Blackjack Edge are strategy trainers. You cannot bet, win or lose real money in them. The chips, bankroll and winnings you see are practice figures that have no cash value and can't be cashed out, transferred or exchanged for anything.

The apps teach strategy and show you the maths. They do not promise that you will win at a casino or anywhere else, and nothing in them is financial, legal or gambling advice. Casino rules and the law differ from place to place, and casinos can and do ask advantage players to leave. If you gamble with real money, that is your choice and your risk. You must be old enough to gamble where you are before you do. If gambling is hurting you or someone you know, contact a help service in your country (in the US, the National Problem Gambling Helpline is 1-800-522-4700).

Store terms

You get the app through Apple’s App Store or Google Play, and the store’s own terms apply to that download. On iPhone and iPad, Apple’s standard Licensed Application End User License Agreement applies to the app alongside these terms. If the two disagree, these terms control, except for the rights Apple’s agreement reserves to Apple. Apple and Google are not parties to these terms, and are not responsible for the app, its support or your claims about it; those are ours.

Warranty and liability

We build the apps with care and fix what's broken, but we can't promise nothing will go wrong on every device. To the extent the law allows, the software is provided “as is”, and we aren't liable for indirect or consequential loss, or for loss of data or profit, that comes from using it. Our total liability to you for anything connected with the software is limited to the greater of what you paid for it through the store in the twelve months before the claim and US$50.

None of that limits what the law does not allow us to limit: liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

Your statutory rights

If you are a consumer, these terms take nothing away from the rights your own country’s law gives you that cannot be waived, including the rights of consumers in the European Union and the United Kingdom to digital content that works as described and to a remedy if it does not. Where these terms and one of those rights conflict, the right wins.

Law and disputes

These terms are governed by the laws of the State of Ohio, USA. Disputes go to the courts of Ohio, except that if you are a consumer you keep the protection of the mandatory consumer laws of the country where you live and may bring a claim in the courts there. Before anything formal, write to us. Most things get fixed faster that way.

Changes and contact

We may update these terms. If we publish a new app that needs terms of its own, it gets its own page and this page says so above. A change does not reach back to a purchase you already made; if we change something that matters, we will say so on this page and update the date below. Our privacy policy describes what happens to your data in the apps.
